Changes to Captive Insurance Companies Annual/quarterly Filing Requirements

Delaware -- long the undisputed choice for incorporations -- is now a great place to create a captive insurance company. Thanks to legislation passed in 2005, Delaware is now poised to become a leader in captive domiciles as well.

    Recently, Insurance Commissioner Matthew Denn issued a general notice to all captive insurance companies:

    Beginning with the 2006 Annual Statement, captive insurance companies domiciled in Delaware that reinsure life insurance policies as part of a securitization transaction shall file quarterly and annual statements on a statutory accounting principles (SAP) basis using forms approved by the National Association of Insurance Commissioners for life insurers.
