Delaware’s legal system has been ranked No. 1 (again)

For those in the know, this news will come as no surprise.

Delaware’s legal system has been ranked No. 1 in the nation for the fifth consecutive year, according to an annual survey released by the U.S. Chamber of Commerce.

The study is a benchmark by which companies, policymakers and the media assess the fairness of legal systems in the 50 states. The more than 1,400 attorneys who participated in the poll were asked to judge a number of factors, including overall treatment of tort and contract litigation, treatment of class action suits and mass consolidation suits, judges’ impartiality and competence and juries’ predictability and fairness.

Governor Ruth Ann Minner may have said it best-

“Delaware’s courts have a reputation of fairness and efficiency, which in turn enhances the fact that Delaware is an ideal location for doing business.”

Score one more for Delaware.

I really like the Delaware courts, and I think that some aspect of their expertise and ability does add to the notion of doing business in Delaware, but I really have to split from Governor Minner on this point.

There are a good number of other things that businesses and business owners will look at before deciding upon a venue in which to conduct business, and while a wonderful forum to settle disputes is upon that list, it’s not really one that I would put at the top. I think that some of the others aren’t addressed in a manner in which they should be. I’d love to see Delaware become as start-up friendly as it could be. I’m not sure that itis there now.
